Heart Arc — Terms of Use

Effective date: [DATE]. Operated by [LEGAL ENTITY / PRACTICE NAME] ("we", "us").

1. Acceptance

By entering your invitation code and using Heart Arc, you agree to these Terms and to the Privacy Notice. If you do not agree, do not use the service.

2. What Heart Arc is — and isn't

Heart Arc is a private, invite-only cardiovascular-prevention pilot. A board-certified cardiologist reviews the information you provide and prepares an educational, prevention-focused report.

3. Eligibility

You must be 18 or older, have received a valid invitation code, and provide accurate information. The service is offered to residents of [applicable U.S. states].

4. Your responsibilities

5. Reviewer clarification & turnaround

A cardiologist reviews your submission and may contact you to clarify information before preparing your report. Estimated turnaround (e.g., 5–7 business days) is a target, not a guarantee.

6. Consent

You will be asked to consent to a cardiologist reviewing your information, to receiving service-related communications, and to these Terms and the Privacy Notice, before you can submit. Your consent (with a version and timestamp) is recorded.

7. Privacy

Your information is handled per the Privacy Notice, including retention/deletion. We do not sell your personal information.

8. Intellectual property

The service, its content, and reports are owned by [LEGAL ENTITY] and provided for your personal, non-commercial use. Do not copy, resell, or redistribute the service.

9. Disclaimers [for counsel]

The service and any report are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose. We do not warrant that the service will be uninterrupted, error-free, or secure.

10. Limitation of liability [for counsel]

To the maximum extent permitted by law, [LEGAL ENTITY] and the reviewing physician will not be liable for indirect, incidental, special, consequential, or punitive damages, or for any decision made in reliance on the report. [Aggregate liability cap — counsel.] Nothing here limits liability that cannot be limited by law.

11. Indemnification [for counsel]

[Standard participant indemnification clause — counsel to draft.]

12. Suspension & changes

We may modify, suspend, or discontinue the pilot at any time, and may update these Terms; continued use after changes constitutes acceptance.

13. Governing law & disputes [for counsel]

These Terms are governed by the laws of [STATE]. [Dispute-resolution / venue / arbitration terms — counsel.]
